Article 2 — Scope of Application
These General Terms and Conditions of Sale (hereinafter "GTC") apply to any order placed on the website www.mikanut.com by a consumer (hereinafter "the Customer"), whether domiciled in Switzerland or in a member country of the European Union.
Any order implies full and unreserved acceptance of these GTC. MIKA NUT reserves the right to modify them at any time; the applicable GTC are those in force at the time of the order.
Article 3 — Products
MIKA NUT sells coated peanut-based food snacks under the brand name MIKA.
Products are described with the utmost care on the website. However, minor variations in appearance or packaging may occur without affecting the product's quality. Photographs are non-contractual.
Products comply with current Swiss food legislation (Foodstuffs and Utility Articles Ordinance, FOAV). For deliveries within the EU, products comply with the requirements of Regulation (EU) No 1169/2011 on the provision of food information to consumers.
Article 4 — Prices
Prices are indicated in Swiss Francs (CHF), all taxes included (TTC) for Swiss customers.
For customers domiciled in the European Union, prices displayed are exclusive of local VAT. The VAT applicable in the country of delivery may apply in accordance with current regulations. MIKA NUT undertakes to clearly inform the Customer of the total amount to be paid before order validation.
MIKA NUT reserves the right to modify its prices at any time. The applicable price is that displayed at the time of order validation.
Article 5 — Order
The order is validated after:
- Product selection and addition to cart
- Entry of delivery and billing details
- Choice of payment method
- Acceptance of these GTC
- Payment confirmation
A confirmation email is sent to the Customer upon receipt of payment. This email constitutes an acknowledgment of receipt but does not constitute definitive acceptance of the order. MIKA NUT reserves the right to cancel any order in case of stock shortage, obvious pricing error, or suspicion of fraud.
Article 6 — Payment
Payments are accepted by the following methods:
- Credit card (Visa, Mastercard, American Express) via Shopify Payments
- PayPal
- TWINT (for Swiss customers)
Payment is due in full at the time of order. Transactions are secured by SSL encryption. MIKA NUT does not store any banking data.
Article 7 — Delivery
7.1 Delivery Zones
MIKA NUT delivers in Switzerland and in member countries of the European Union.
7.2 Lead Times
Orders are shipped from Switzerland within 1 to 3 working days following payment confirmation. The estimated delivery time is 3 to 10 working days depending on the destination.
7.3 Shipping Costs
- Free delivery for orders over CHF 80
- CHF 8.90 for orders under CHF 80
7.4 Customs and Taxes (EU customers)
Orders shipped from Switzerland to the EU may be subject to customs duties and import taxes. These charges are the sole responsibility of the Customer.
7.5 Risks
The transfer of risks occurs at the time of handover of the package to the carrier. In case of loss or damage, the Customer must report the problem to MIKA NUT within 5 working days following the estimated delivery date.
Article 8 — Right of Withdrawal and Returns
8.1 Legal Exclusion for Foodstuffs
In accordance with Article 16, point c) of European Directive 2011/83/EU, the right of withdrawal does not apply to foodstuffs likely to deteriorate or expire quickly. No returns or refunds will be accepted once the order has been shipped, except for defective products, error by MIKA NUT, or non-conformity.
8.2 Procedure in case of problem
The Customer must contact MIKA NUT at contact@mikanut.com within 48 hours of receipt, attaching photos of the product and packaging.
8.3 Note for German customers
Under German law (§ 312g BGB), foodstuffs with a long shelf life may benefit from a 14-day right of withdrawal. Contact us at contact@mikanut.com for any request.
Article 9 — Legal Guarantees
Products benefit from the legal guarantees applicable under Swiss law (CO art. 197 ss) and, for EU customers, the legal guarantee of conformity provided for by Directive 2019/771/EU (2 years from delivery).
Article 10 — Liability
MIKA NUT cannot be held responsible for delivery delays attributable to the carrier or customs services, for damages resulting from improper use of the product, or for undeclared allergies despite available information.
MIKA products contain peanuts and may contain traces of other tree nuts.
Article 11 — Intellectual Property
The MIKA brand, logo, visuals, texts, and content of the website are the exclusive property of MIKA NUT. Any reproduction without authorization is prohibited.
Article 12 — Applicable Law and Competent Jurisdiction
Swiss customers: These GTC are subject to Swiss law. In case of dispute, the courts of the Canton of [YOUR CANTON] have sole jurisdiction.
EU customers: In accordance with Regulation (EU) No 1215/2012, consumers domiciled in the EU may bring proceedings in the courts of their country of residence.
